Cases which have appeared before Plymouth Magistrates Court this week
THE following cases have been dealt with by Plymouth magistrates.
GARY BOOTH, aged 37, of Valletort Place, Plymouth: racially-aggravated threatening behaviour — fined £100 and ordered to pay £15 victim surcharge.

LEE BORDA, aged 19, of Beaufort Close, Plymouth: theft — jailed for six weeks.
ANDREW BUCK, aged 33, of Station Road, Keyham: possession of heroin and amphetamine — fined £100 and ordered to pay £15 victim surcharge.
CINDY DOWNTON, aged 38, of North Down Crescent, Plymouth: possession of methadone and obstructing or resisting a constable in the execution of their duty — fined £400, ordered to pay £85 prosecution costs and £15 victim surcharge.
STEVEN GUNNINGHAM, aged 19, of Whitleigh Avenue, Plymouth: possession of cannabis — fined £50 and ordered to pay £15 victim surcharge.
JOHN HANNAH, aged 38, of Restormel Road, Plymouth: breach of a restraining order — 12-month community order with 60 hours unpaid work.
DARREN PATTENDEN, aged 44, of Camperdown Street, Plymouth: failing to provide specimen for analysis and using a vehicle without a test certificate — banned from driving for 20 months, fined £85, ordered to pay £85 costs and £15 victim surcharge.
ANDREW PEARSE, aged 40, of Bampfylde Way, Plymouth: common assault — two-year community order with Domestic Abuse Programme and ordered to pay £150 compensation and £100 costs.
HONNIE PEMBERTON, aged 29, of St Levan Road, Plymouth: criminal damage and breach of a conditional discharge — fined £75 and ordered to pay compensation of £50.
NATASHA BERNADETTE SMITH, aged 31, of Florence Street, Plymouth: racially-aggravated common assault — ordered to pay £150 compensation, fined £70 and ordered to pay £15 victim surcharge.
ANTHONY STEWART, aged 25, of Old Laira Road, Plymouth: threatening behaviour — two-month community order with a curfew.
GARETH STRONG, aged 32, of Tamar Street, Plymouth: criminal damage — six-month community order with Victim Awareness Programme, ordered to pay £135
JAMIE TAYLOR, aged 18, of Egerton Road, Plymouth: theft from a shop and breach of a conditional discharge — four-month community order with daily curfew, ordered to pay £40 costs.
SARAN THAYA, aged 28, of Victoria Place, Stoke: drink-driving — banned from driving for 12 months, fined £100, ordered to pay £85 prosecution costs and £15 victim surcharge.
BEN WOOD, aged 23, of Eastbury Avenue, Plymouth: theft from a shop — six-month community order under probation supervision.

“Why bother is what I wonder. To most of the people who constantly re-appear on this story Magistrates present at BEST a minor inconvenience in their chosen lives of crime, their punishments likewise. Why bother?”

“There is a theory that sentencing people (particularly first time offenders) to a stretch in prison for relatively minor offences which most of the above are, actually increases their likelihood of further offending due to "tricks of the trade" they are likely to pick up whilst coming into contact with hardened criminals and the culture of crime which exists inside. So yeah you might think you have it all sorted in the US by locking up everyone but you may just be making the situation worse.”

“Don't they ever sentence people to confinement over there? Many of those offenses would have ended up with 6 months to a year in jail over here.”
