Firm's director is fined £3,708 over fly-tipping in the South Hams

A DIRECTOR of A D Building Limited has been ordered to pay nearly four thousand pounds in fines for his connection with a fly-tipping incident in the South Hams.

Anthony David Leaves, aged 52, of Windsor Road, Higher Compton, appeared at Torquay Magistrates Court after his name was discovered as part of a larger investigation into fly tipping.

Altogether Mr Leaves was ordered to pay £3,708 in fines.

Mr Leaves pleaded guilty to failing in his duty of care to ensure that when transferring asbestos roofing sheets to a third party he failed to ensure that the third party was a licensed waste carrier in order to prevent the waste from being fly-tipped.

A D Building Limited, of which Mr Leaves was a director, was also prosecuted and the company was fined a total of £1,846.50. Mr Leaves pleaded guilty to all counts on behalf of the company.

A D Building Limited undertook a building contract at Kingsacre Nursing Home, Ermington. Part of the works involved the demolition of an outbuilding resulting in the need to dispose of 32 corrugated asbestos roof sheets.

Mr Leaves employed the services of a waste carrier, who turned out to be unregistered, and the asbestos sheets have never been found or otherwise accounted for.

Both Mr Leaves and the company were prosecuted on the basis that they failed to properly check that the person he passed the asbestos on to was licensed with the Environment Agency and that the waste was properly disposed of.

A spokesman for South Hams District Council, who prosecuted the case, said afterwards: "Mr Leaves was to some extent unfortunate to be before the court. His name only came up in the course of a much wider investigation into other, mostly unrelated, matters.

"However, this demonstrates that South Hams District Council will continue to use all available legislation to prevent the South Devon countryside becoming an eyesore at the hands of unscrupulous fly tippers."

    “Good Job the incinerator is being built no more fly tipping, Oh Asbestos does not burn! Well just bury it by the incinerator because most of Camels Head is landfill from the asbestos from the Dockyard.”

Asbestos taken to landfill has to be put into specially designed cells for the exact reason that it is a danger to health when it leaks out into the water supply or soil. Get your facts straight before accusing people of scaremongering.”

    “Asbestos sheets and slates are buried in the ground as the asbestos is not harmful to the water table just more scare mongering by people making huge profit from disposing of it, the general public can take it there selves to chelson meadow and put it in a special skip wihich was then buried at chelson before it closed.”

    “This did not shock me to read this as I have had the misfortune to use this company, it is true what they say you pay for what you get. They were cheap but did a terrible job and would never come back to put things straight. Wish I had paid the higher prices first as in the end it cost me loads more in the end!! Cowboys spring to mind!!”

    “Who actually owns the nursing home. Surely he or she bears some responcibilty too. Afterall the waste i assume came from the nursing home and you should make sure you use a reputable firm, not these cowboys. Its all about greed. You employ monkeys who pay peanuts and this is the result.”
