Motorist claims ticket at Dean Clarke car park in Exeter was unfair
A motorist has warned people not to use a car park close to the crown court after receiving an "unfair" ticket.
The woman parked at the Dean Clarke car park and purchased an all-day ticket. After walking away she returned to her car after forgetting something and a parking attendant was already at her car.

She said: "This man was about to talk a photo of my car as he said I was slightly over the line. The lines are not clear down there but I said 'no problem' and moved it straight away. Nothing more was said and he walked away without giving me a ticket.
"It was no more than a minute after I had originally parked."

Ms Short said she has received a Penalty Charge Notice for £60 if she pays within 14 days and £100 within 28. She has appealed the decision.
"I moved my car immediately and it would have been nice to tell me I was being given a ticket. At least I would have known. I would just warn people not to park there."

Last year the British Parking Association was asked by the Government to introduce the safeguard and the legislation came into force in October alongside a ban on clamping on most private land.
As part of our campaign hundreds of readers contacted us in support. The majority of complaints were regarding the activities of Premier Parking Solutions, based in Newton Abbot, with car parks in Dean Clarke House and outside Exeter Central Station particular trouble spots.

“What I find most disappointing is that it appears that this Newspaper has likewise failed to grasp that these people have absolutely no claim whatsoever to any "official" status, but are purely parasites upon the car parks of legitimate businesses.
What you should be advising your readers is that they have no necessity to take any of these demands seriously and that they should simply be ignored.
NO-ONE OTHER THAN PUBLIC BODIES, SUCH AS POLICE, COURTS OR COUNCILS HAS ANY RIGHT TO FINE OR ISSUE PENALTIES TO OTHER CITIZENS.”

“And just to clarify: these people issue all types of threats precisely BECAUSE they have no legitimate means of collecting the money.
Councils never threaten you, they just ask, because they know that, if you don't pay, the CAN and will recover via a Court.

“Boycott the ticket is the easiest way of dealing with it. There is absolutely no basis in law for the issue of private parking fines (despite the lies the companies will throw at you) and therefore they cannot be enforced through the courts or in any other way.
All this lady (or anyone else for that matter) has to do is to simply throw every iten of correspondence which will be sent to her straight in the bin. She will be threatened with everything from being taken to the European Court to having her cat kidnapped and held to ransom; but when these cowboys realise that they are wasting their time they will cut their losses and go away.
Guaranteed!!
By talking about appeals and that sort of nonsense, you give them the idea that you actually take their demands seriously. Just ignore them.”

“So boycott these car parks!
Use council car parks if you want to be assured of fairness as far as possible, you just don't here of these practices going on regularly in council car parks.
Boycott this one, Central station and Exe Bridges retail park all of which have rampant fining practices. The companies get paid by the revenue they raise so have every incentive to fine as much as possible not where it is reasonable to do so...”
