Prison for man who filmed friend's arrest
A MAN who was arrested during a night out celebrating his friend's birthday has been jailed for eight weeks.
David Saville, aged 28, of Millwood Drive, pleaded guilty to using threatening words and behaviour causing harassment, alarm and distress but not guilty to obstructing and resisting a constable in the execution of their duty.

Angela Furness, for the Crown Prosecution Service, explained how at around 1.20am, on October 16, while buying a pizza on Union Street in the City Centre, Saville made a video on his mobile phone of his friend, whose birthday he was celebrating, being spoken to by the police.
Saville said: "I was staying out of trouble, I wasn't going to the wrong places or out with the wrong people.
"The only reason I was filming was because I wanted to show my friend what he was being like and because it's normally me being arrested."
Saville's solicitor, Stephen Walker, explained how his friend had also been arrested on October 16, but had not been prosecuted over the incident.
He said: "The police credit that Saville tried to get his friend home but then the mobile phone came out and, as the incidents progressed, the behaviour of Saville deteriorated. However since the incident he has made significant progress."
Saville had already been placed on a suspended sentence on April 7 last year but then committed these offences.
Magistrate Yvonne Quinlan said: "The suspended sentence that you were given by the court in April has been breached so you broke an order of the court."
She then activated Saville's suspended sentence and placed him in custody for eight weeks.

“I did look at the vid but in truth there didn't seem to be much in it to warrant being arrested and charged. Yes, he was behaving like a muppet but if you arrested and charged everyone for that then half of Plymouth would be awaiting a court case.”

“He wasn't arrested for the video............it's NOT illegal to film/ take pictures in a public place. Everyone who watches the 'fly on the wall' Police documentaries/ series should know this! When our Boys & Girls in blue have to deal with some of the unsavoury characters who walk our street and they complain about the camera, they are told straight, it's not illegal to film in a public place.................if it were, how would photographers get half their pictures!

I havn't watched the vid yet, but unless it was recorded straight onto a memory stick/CD/DVD, sealed in a bag and had no chance of any editing software applied to it (and can be verified to that effect), it couldn't be used in court anyway!”

."Doesn't the story say "the behaviour of Saville deteriorated". This is probably why he was arrested NOT just because he was stood there filming with a mobile phone. UNQUOTE .... More likely that the officers decided to realise that the filming wasnt showing them in a good light and decided to use a wrong law and saying "stop filming" .... he most probably carried on - as is his right - and they then decided to inflame their misguided and thick brain cells and make things worse to the point where they turned it into a situation where he got arrested . Tell you how I know that ? Been there myself in a public place where these thickos use every trick to convince you are the criminal..... even though the laws of the land are with you .”
