Truro City in winding up order
TRURO City have been served with a winding up order by the commissioners for HM Revenue and Customs.
A wind up petition was issued yesterday and will be heard at the Royal Courts of Justice in London on October 31.

The news comes as a major blow for City, who have enjoyed huge success on the field after five promotions in six seasons.
They are currently 11th in Blue Square Bet South after Tuesday night's win at Maidenhead United.

Truro City chairman Kevin Heaney was the front-runner to buy Plymouth Argyle out of administration.
City officials have responded to the order by issuing the following statement:
"Her Majesty's Revenue & Customs have taken an unduly aggressive approach to a tax liability by issuing a winding-up petition.
"The background to this matter is that TCFC were chasing HMRC and only recently were advised of the amount of debt due," the statement from the club's lawyers said.
"This was as a result of HMRC failing to demand this debt over the last two years.
"TCFC has previously been in dispute with HMRC over wrongly assessed VAT and this was settled in TCFC's favour," the statement went on to say.
"TCFC are dismayed by the actions of HMRC in bringing and advertising the petition without allowing the matter to be settled privately and understand the issuing of petitions against football clubs is a matter of HMRC policy which has been effected against a number of football clubs in recent times."
The notice, which appeared on the London Gazette website yesterday, read:

A Petition to wind up the above-named Company, Registration Number 05269610, of 31 Lemon Street, Truro, Cornwall TR1 2LS, presented on 25 August 2011 by the Commissioners for HM Revenue and Customs, of Bush House, Strand, London WC2B 4RD, claiming to be Creditors of the Company, will be heard at the Royal Courts of Justice, Strand, London WC2A 2LL, on 31 October 2011, at 1030 hours (or as soon thereafter as the Petition can be heard).
Any persons intending to appear on the hearing of the Petition (whether to support or oppose it) must give notice of intention to do so to the Petitioners or to their Solicitor in accordance with Rule 4.16 by 1600 hours on 30 October 2011.

All the money that PandA must have made out of Argyle has to be investigated, we must be talking over a million. How can the quantify that amount?”

At least IF the BIL bid for Argyle is on the table, as we are led to believe, then we would hope that the FL suits are aware of this development and the bid slides off and into the bin. I don't know enough about finance, tax and HMRC to comment in depth but as a layman I just think how incompetent some of the big people at TCFC must be !!!

Does this spokesman think he/she are talking to idiots. As the pay was paid / gate money taken etc they must have known what the tax liability would be (roughly) and so you store that in the piggy bank getting a little interest until the HMRC ask for it. Then ... you pay. It seems to me that someone at TCFC has spent it and so = winding up order.
I wonder if the tax liability was spent as a down payment on another venture which has gone pear shaped. So now - lost the down payment = winding up order.”

“Mr. Guilfoyle is an Officer of the Court. He has to follow in administration the methods as laid down by those Courts.
Sadly the cost of a Judicial Review by the Courts into the actions of MR. G. will cost thousands, maybe tens of thousands, of pounds.
That is assuming you will find any legal firm willing to investigate one of their own.
Whether or not the Courts will conduct their own review is another matter but Mr. Guilfoyles report to the Court should be interestng reading.”

“As i have said all along . There should be an investigation as to how much the administrators have been sucking out of Argyle whilst the Heaney nonsense was going on. Surely he has sucked out money on a non starter and should be made to reveal how much he charged Argyle whilst it was all going on. He has had the purse strings all along whilst everyone has gone without.”

“While many of us were not in possession of all the facts we realised from articles in the Herald that Bishop International was indicating a bad deal for Argyle. Now the Evening Herald should ask to have an interview with Guilfoyle. He really has some explaining to do. First question to Guilfoyle. "How much have you made out of the club so far?" Second question "How much research did you do into the suitability of Mr Heaney and Bishop International?"
I would suggest very little research with regards to suitability.
Considering how many extensions Guilfoyle gave Heaney there are enormous question marks hanging over Guilfoyle's suitability as an administrator. At least Mr Brent is honest and says he is not a football fan rather than trying to con us into believing he is something that he is not. I would rather pay Mr Brent as an administrator as he appears more capable.”

Ah my apologies. I just can't believe people are trying to defend the ginger prat. The success he has brought Truro City will be at a hell of a price if he can't pay up. The ground and land is mortgaged to the hilt so where would City relocate if this all ends in tears? There's not another ground in Cornwall where this level of football could be played.
For the damage he has caused Argyle, his rubbish has delayed us being taken over by someone with the funds to complete the deal, I hope this ruins him. For the people of Truro I hope that there is someone else who can take you over and not too much damage is done.”
